General Terms and Conditions and Mandatory Legal Information
1 Scope / Identity of the Provider
These General Terms and Conditions apply to all contracts that you conclude with us, Sintech GmbH, Kurmainzstraße 14, 74389 Cleebronn, Email: info@sintech-shop.de, Phone: +49 71353038912, Fax: +49 71353038914, via our online shop at www.sintech-shop.de.
2 Definitions / Applicable Law
2.1 A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor independent professional activity.
2.2 An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
2.3 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and have your habitual residence in a member state of the European Union, this choice of law does not apply to the extent that it deviates from mandatory provisions of the state of your habitual residence, from which no deviation may be made by agreement.
3 Contract Language / Storage of the Contract Text
3.1 The contract language is German.
3.2 When ordering via the shopping cart function of our online shop, you can print or electronically save the complete contract terms (order data, general terms and conditions, and cancellation policy) using the browser's print function before completing the order. They will be sent to you again by email with the confirmation of receipt of your order. In addition, the contract text will be stored by us in compliance with data protection regulations and will be available for retrieval even after the order has been completed.
3.3 If you send us inquiries regarding the conclusion of a contract via other contact options provided in our online shop (e.g., by email), you will receive the complete contractual terms and conditions by email so that you can print them out and save them electronically.
4 Conclusion of the Contract / Correction of Input Errors
4.1 The offers published by us constitute binding offers to conclude a contract.
4.2 You can place a binding order for the goods offered in our online shop using the "Shopping Cart" function. To do so, place the desired item in the shopping cart using the corresponding button in the respective offer. You can then place multiple items in the shopping cart one after the other. You can access your shopping cart using the corresponding button in the navigation bar. There, you can make any desired changes or initiate the ordering process by clicking the "Proceed to Checkout" button.
Then enter your shipping details and select your preferred payment method. You can check your selections and entries at any time using your browser's "Back" function and correct any input errors, or cancel the order process by closing the browser window. In addition, all selections and entries will be displayed again on the order overview page and can be changed and corrected there using the corresponding buttons.
By submitting your order using the "Buy" button, you declare your binding acceptance of our offer, thereby concluding the contract.
4.3 Inquiries regarding the conclusion of a contract that you send to us via other contact options provided in our online shop (e.g., by email) are non-binding. We will then submit a binding offer, which you can accept within one week, unless otherwise stated in the offer.
5 Prices and Payment Terms
5.1 The prices stated in our offers are total prices and include statutory VAT.
5.2 Any shipping costs incurred are not included in the stated total price. Whether additional shipping costs apply and their amount can be viewed via a correspondingly labeled button on our website and, if applicable, on the respective product page. If additional shipping costs apply, these will also be shown separately during the ordering process.
5.3 For deliveries to countries outside the European Union, additional costs (e.g., taxes, customs duties) may apply, which you must bear and pay directly to the relevant authority.
5.4 The following payment methods are available to you subject to the terms and conditions specified therein:
PayPal: You can pay by credit card, debit card, prepaid card, invoice, or SEPA direct debit via the payment service provider PayPal (PayPal Europe S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg). PayPal's terms of use apply, available at: https://www.paypal.com/de/webapps/mpp/ua/legalhub-full. To use PayPal's payment services, you may need your own PayPal account. Payment by invoice also requires a prior positive credit check. For payment by invoice, we assign our claim against you to PayPal. You then pay the invoice amount to PayPal immediately upon receipt of the invoice within the agreed payment period. If you use the SEPA direct debit procedure, PayPal will notify you by email before your account is debited. Otherwise, your account will be debited immediately upon completion of the payment.
SEPA Direct Debit: When paying via SEPA Direct Debit, you instruct us to collect the invoice amount from your specified account by direct debit. Your account will be debited after the goods have been dispatched and you have been informed in advance about the specific time of the debit. The advance notice period is reduced to five days.
Prepayment: When paying in advance, you pay the invoice amount after the contract has been concluded and we have received a payment request by bank transfer to our account specified in the payment request. The goods will be dispatched after you have instructed us to pay within the agreed delivery period.
5.5 Unless otherwise agreed above, any payment claims against you arising from the concluded contract are due for immediate payment.
6 Delivery Conditions
The delivery conditions applicable to the respective offer (delivery types, applicable delivery costs, and delivery date) can be viewed via a corresponding button on our website or on the product page of the offer.
7 Warranty Rights
Your warranty rights in the event of defects are governed by the statutory provisions.
8 Alternative Dispute Resolution / Place of Jurisdiction
8.1 We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
8.2 If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from and in connection with the contract concluded with us is our registered office. The same applies if you do not have a general place of jurisdiction in a member state of the European Union or, in the event of legal action against you, your place of residence or habitual abode is not known at the time the action is brought.
